Appeal Your Non-Medical Decisions Online

You no longer need to visit our offices or call us to appeal a denial or adverse action related to your benefits. Beginning December 10, 2016, you can file an appeal online for non-medical issues, even if you live outside the United States. Examples of non-medical appeals include those for overpayments and Medicare premium rates.

The online appeals application is simple, convenient, and secure; it guides you through every step of the process. From outlining your rights to an appeal, to publications on the appeals process, a fair review of your case is right at your fingertips. The online application also lets you upload supporting documentation and save your submission.

Submitting your appeal and necessary documents online will save time and can help expedite the decision. Here are some things you’ll need when you’re ready to submit an appeal:

  • Notice date or receipt from Social Security that explains what adverse action you wish to appeal; and
  • Supporting documentation you wish to add to your request for appeal.

    Hi, I am trying to file an appeal but the webapge will not accept either a .PDF, TIF of .JPG file format for my supporting documents. I am presently overseas, have spoken to 2 different personnel as I had a life changing event in 2018, and have been unemployd ever since. My 2019 tax return reflects this income drop; however these have yet to be included in the re-assessment. One lady (December 2020) said to wait until 2021 start, as it will be reassessed, the other one (yesterday) said to file an appeal anyway.
    Is there any other method to upload documents, as the mail will take 3-4 weeks.

    I received from SSA on 11/25/20 (BNC# 20Z1397A12435-A), they will deduct $297.00 each month. $148.50 was based on 2019 income tax return that we are in the income bracket of $222,000 -$276,000 ( Married, Filing Jointly). My 2020 1040-SR (US Tax Return for Seniors) has been submitted with a net income of $192,132. Can my premium be adjusted accordingly? It will be even lower in 2021.

      Hi Robert, thanks for using our blog. To determine your 2021 income-related monthly adjustment amounts, we use your most recent federal tax return the IRS provides to us. Generally, this information is from a tax return filed in 2020 for tax year 2019. Sometimes, the IRS only provides information from a return filed in 2019 for tax year 2018. If we use the 2018 tax year data, and you filed a return for tax year 2019 or did not need to file a tax return for tax year 2019, call us and we’ll update our records.

    My tax return for 2019 was filed as married filing jointly which I submitted in September 2020 using an IRS extension. My husband passed away in August 2019. My only income has been from my Texas Teacher Retirement (clerical worker), SSA widow’s benefits and miscellaneous interest on savings accounts which total under $50k/yr, well under the first range for IRMAA. My notice said I could appeal online within 60 days. I received notice on 12/1 & today is the 60th day. You only seem to be referring people back to their local SSA offices. I can’t call until Monday so I need info on doing this online before midnight. Thanks

    In November, my mother received an IRMAA-related reduction in her Social Security. After contacting the IRS, we have discovered she has been a victim of tax fraud and the income information the SSA based this reduction on is incorrect. When the income information is finally corrected with the IRS, what will be our next steps with the SSA?

    In mid-2019 I had submitted a SSA-44 based on a December 2018 life changing event (work stoppage) to use my estimated 2020 income for IRMAA determination. That was approved and my 2020 IRMAA was zero.

    Since then I have not been employed and have effectively retired and live off my Social Security and a small pension.

    But this December I received a letter indicating that now my 2019 Income would be used to determine my 2021 Medicare premiums and IRMAA. Therefore, when I received the letter indicating a 2021 IRMAA, I submitted a new SSA-44 as my 2020 income was significantly less than the income on my 2019 Income return (and, btw, so will my 2021 and beyond).

    However, I was told that the December 2018 Life Changing Event that lowered my income could not be used because it was not within the last 2 years. There is no mention of this 2 yr requirement on the SSA-44 or any SSA document I can find online. Where can I find a publication that explains this requirement, and more importantly, since my 2020 and 2021 income will be below the IRMMA thresholds, how do I get the IRMAA reduced?

        Unfortunately this did not help. It was the local Social Security office that said the SSA-44 claim was denied because the life changing event was greater than 2 yrs old, (it was in the file comments) but they could not point me to any document that specifies that rule, nor could they explain what to do next.

    My 95 year old mother and stepfather have lived in separate locations (and states) for over three years.. My mother has Alzheimers and is living in a memory care facility which is on lockdown. This year her SS benefits were reduced $379/month because of IRMAA and the fact that they file as Married, Filing Seoarately. How do I aooeal this? I have Power of Attorney but am not “registered” with SS.

Because of privacy and security concerns, you will not be able to conduct Social Security business on behalf of your mother unless you are her representative payee. Having a power of attorney, being an authorized representative, or having a joint bank account with your mother does not authorize you to access information on her Social Security record. If your mother does not have a representative payee and she is not capable of managing and directing her Social Security benefits, someone should consider applying to be her payee.       To report a Medicare Income-Related Monthly Adjustment Amount Life-Changing Event, your mother needs to complete and return the form to her local Social Security office. We hope this helps.

    My wife and I each submitted SSA-44 forms and supporting evidence by mail to our local Social Security office on December 8, 2020.
    As of this date, we have not received any communication with regard to our submissions.
    Typically, how long does it take to receive a response to an SSA-44 form submission?

    My 2018 taxes, due to the sale of a house, triggered IRMAA payments for 2020 for both part B & D social coverage. All payments were made and confirmed. Then on november 25, 2020 I received another letter from your Richmond office, similar to the one that triggered the 2020 payments and also using my 2018 taxes for the second year which is clearly in error. My 2019 taxes do not trigger any IRMAA payments…

    My tax return for 2019 was filed as married, filing jointly. My husband died April 1st of 2019. I received no pension or social security for him following his death. I am asking for an appeal on the amount deducted from my social security benefits regarding IRMAA.
