Compassionate Allowances Speed Help to People with Severe Disabilities

Disability can happen to anyone. If you suffer from a serious medical condition that prevents you from working, time is of the essence when it comes to applying for Social Security disability benefits. Although Social Security is committed to processing disability claims as quickly as possible in all cases, our initial claims process typically takes three to five months.
Because compassion is a cornerstone of our public service commitment, in some cases, we’re able to expedite the application process through our Compassionate Allowances program. Social Security uses Compassionate Allowances to identify people whose medical condition is so severe, they obviously meet our disability standards. Under the Social Security Act, we consider you disabled if you can’t work due to a severe medical condition that is expected to last at least one year, or result in death.
Social Security pays benefits under two programs, Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) programs. Our disability program provides benefits and Medicare eligibility to workers with disabilities who paid into the Social Security trust fund through payroll taxes. Under some circumstances, children and family members can receive disability benefits. SSI pays benefits to disabled persons of all ages with limited income and resources. SSI benefits are not paid out of the Social Security trust fund.
Farber’s disease and Tay Sachs disease in children, and advanced pancreatic and ovarian cancer in adults are examples of the 223 conditions on the Compassionate Allowances list. Others include Huntington’s disease and Creutzfeldt-Jakob disease, which cause rapid brain deterioration in otherwise healthy adults. The Compassionate Allowances initiative also provides grants to medical researchers to identify other conditions that may qualify for this list. I have stage 4 metastatic (liver lesions) colon cancer.
This condition appeared about 8-9 months after I returned to work from LOA for cancer surgery and
treatment. Oncologist immediately started me back on
chemo.
Unfortunately, I didn’t realize at the time of occurrence
that I had a qualifying SSDI condition, and continued to
work, though the chemo and other issues caused me
problems.
I have been struggling along with this for almost 2 years and now feel that I need to stop. Oncologist
tells me liver lesions are inoperable, have resisted
all treatments to shrink them sufficiently, and is now
only doing ‘maintenance’ chemo which will continue
indefinitely.
The personnel mgr. at work tells me I need to go and
apply for SSDI before my hours can be reduced or any
steps can be taken at work. I fear if I do this, my claim
will immediately be rejected due to my having been
working full-time with this condition for over year and
half. If I tell the SSDI Rep. that I’m going to have my
hours at work reduced, will I be allowed to apply?
I’m sure I have a Compassionate Allowance condition
but may have ‘shot myself in the foot’ by failing to
apply for SSDI sooner. Will I have to quit my job al-
together to be considered for benefits? My treatments
are ongoing and I only have my company-provided
insurance, cannot afford a lapse in coverage. I am
almost 61 years old.

A person can apply and may still be eligible for disability benefits under the Social Security Disability Insurance (SSDI) program if they work. However, their earnings cannot exceed a certain amount. This is called the Substantial Gainful Activity (SGA) limit. In 2017, the SGA limit is $1,170 per month (or $1,950 for blind applicants). In addition to the amount of money you make, Social Security may also look at the number of hours you’re able to work. If you decide to apply, you can apply online. Also, you should know that individuals can qualify for Medicare after receiving disability benefits for 24 months. We start counting the 24 months from the month you were entitled to receive disability, not the month when you received your first check. We hope this information helps.
