Why is the representative payee name on my SSA-1099 form? Why is the SSA mailing the SSA-1099 form to the representative payee. The representative payee manages my benefits, not my federal taxes.

Representative Payee cannot file tax returns on behalf of the income tax payer. The IRS doesn’t recognize them as a representative of the party.

Even though the beneficiary never appointed a “Representative of Parties” under 20 C.F.R. 404.1707, the SSA mails nothing to the beneficiaries. The SSA mails everything to the representative payee.

Doesn’t the SSA Commissioner know the difference between a “Representative Payee 20 CFR 404.2004″ and a Representative of Parties 20 C.F.R. 404.1703”

Even with advanced designation the beneficiary is only appointing a “representative payee” and not a “representative of parties”.

Disabled beneficiaries are discriminate against by the SSA Commissioner.

The SSA Commissioner doesn’t even let a legally competent adult change their address without permission from the representative payee.

      • Tony

The SSA Commissioner cannot read or follow instructions. Maybe the SSA Commissioner need a representative payee too.

Box 7 of Form SSA-1099-SM ask for the address only.

Why did the SSA Commissioner put the representative payee’s name and address in this box?

Why does the SSA Commissioner mail the Form SSA-1099-SM to the representative payees instead of to the beneficiaries?

All of the beneficiaries mail is being mailed to the representative payees without written authorization from the beneficiaries appointing the “representative payee” as a “representative of parties”

It is discrimination based on disability. The SSA Commissioner discriminates against vulnerable disabled beneficiaries.

Will you tell people that that will have to pay $170. Twice, which is equal to $340. For Medicare plan B even though, they may have Senior Advantage B that’s covered by your pension insurance. Therefore, it’s like you are you are paying triple for Medicare B

  6. Sybal J.

The online Social Security site, with the MyAccount is great. It is so easy to use. The website designers obviously put a lot of thought into ease of use for the users. It was so easy to change my deposit account to a new bank

Do I have to file income tax?

    • Ann C.

Hi, Brenda. Thanks for your question. You must pay taxes on your benefits if you file a federal tax return as an “individual” and your “combined income” exceeds $25,000. If you file a joint return, you must pay taxes if you and your spouse have “combined income” of more than $32,000. If you are married and file a separate return, you probably will have to pay taxes on your benefits. For more information, visit our Benefits Planner.  For tax questions, you will need to contact the IRS. Their toll-free number is 1-800-829-1040 or you can visit their website. We hope this information is helpful.

When will the US citizens living outside USA will be allowed to open “My Social Security” account ?When will the discrimination end??

    • Tony

Join the club. The SSA Commissioner discriminates against Title II disabled individuals too. The SSA Commissioner denied them full access to their my social security account.

In 42 U.S.C. 405(j)(1)(B) it states, “In the case of an individual entitled to benefits based on disability, the payment of such benefits shall be made to a representative payee if the Commissioner of Social Security determines that such payment would serve the interest of the individual because the individual also has an alcoholism or drug addiction condition (as determined by the Commissioner) and the individual is incapable of managing such benefits.”

For Title II disabled individual, the SSA Commissioner determines if the disabled individual also has an alcoholism or drug addiction condition (not a physical or mental condition) and is incapable of managing such benefits.

The SSA discriminates against Title II disabled individual only because they have a physical and mental condition.

The SSA Commissioner didn’t read the second half “because the individual also has an alcoholism or drug addiction condition.”

When will the discrimination end? End the discriminatory representative payee practice and give them full access to their online account.

    • Tony

The U.S. federal government doesn’t allow discrimination in federal programs. It is discrimination to base something solely on a person’s disability. This is why it is based off an alcoholism or drug addiction condition. An alcoholism or drug addiction condition is not a legal disability protected under the ADA.

      • Tony

Individuals on SSI cannot give away their resources. SSI is taxpayers money to be use solely for the need of the individual. They cannot be giving away our taxpayers money to some else. A representative payee would make sure the money is used solely for the needs of the individual.

The legally mentally incompetent or physically incapacitated individual would have a guardian appointed to them by the court. These individuals are not legally competent adults and cannot advanced designate their guardian as a representative payee. The appointment of a representative payee is according to SSA law and regulations.

        • Tony

42 U.S.C. 1383(a)(2)(ii)(ll) is the same as 42 U.S.C. 405(j)(1)(B) for individuals disabled on SSI. The SSA cannot discriminates against them based solely on their disability. They must also have an alcoholism or drug addiction condition.

The SSA hires a bunch of Nazis to discriminate against disabled individual.

During world War ll, the USA allies were Communist Russia and Communist China. Now they are our enemies and the Nazis in Germany are our allies. Nothing more than wolves in sheep clothing. How long will it be before they become our enemy again. The Nazis influence the US to discriminate against the disabled. There are white nationalist working for the SSA to discriminate against disabled individual.

    • Tony

The SSA hires a bunch of Nazis and white nationalist who control the SSA.

People who live in foreign countries are foreign sympathizers. You have to pledge your allegiance to the white nationalist of America. Once you set up an account, you can access it anywhere.

      • Tony

The use of the American computer routers system can get you around the white nationalist security protocol after you set up an account pleading allegiance to the white nationalistof America. It is the modern day underground railroad.

Can you tell people to brace for an approximately 25% cut to people’s Social Security benefits in 10-15 years due to the Social Security Trust Fund running out? Everybody on these benefits needs to know about this ahead of time so they can adjust their spending to accommodate the cuts.
