  1. I gave the P>O> my SScard when I applied to get my passport w my married name,I had done so with SS office
They never sent my card back,How do I get a copy of my card

      • Mr Fernandez: Can you please tell me the date of the policy change that only attorneys can represent a claimant at the ALJ level and the rationale behind that decision?

        • Thank you for your question Bob. The Social Security Administration (SSA) does not require a claimant to have representation at any level, even at a disability hearing or at federal district court. We neither encourage nor discourage representation. The Social Security Act requires that we notify any claimant who is not represented by an attorney, and who receives an adverse determination, about the options for obtaining attorney representation and the availability, to qualifying claimants, of legal services organizations that provide legal services free of charge (e.g., legal aid groups). The information SSA furnishes must be consistent with the basic policy that SSA is neutral with respect to encouraging or discouraging representation. SSA will not refer the claimant to a specific organization, nor can SSA determine whether a claimant qualifies for legal services free of charge. Click here for more information about representation.

          • You will be denied unless you have a lawyer who knows the games they play in order to deny you. If I am denied this go-round, will be getting one. I have the medical report from my first attempt and when I went on line to appeal,EVERYTHING was missing. It asked if I would like to apply!?!?!

          • i am shocked and disgusted at how people are bashing our government. I have a lawyer and i got denied the first time. I have only talked to nice people that haVe been helpful and kind. Everyone needs to be kind to others and maybe have a better attitude. i appreciate the fact that we even have this so that we can receive help. I think you all need to get lawyers and stop bitching
about our ssi and ssa programs.

  2. I have chronic kidney disease, hyperlipidemia, COPD, severe rheumatoid arthritis, and I did appeal. You turned me down again. Don’t tell people to appeal when you’re just going to deny them again. You should be ashamed of yourself. When I applied last year I was denied and my appeal was denied. Now I have RA severly and this year I don’t have enough work hours to qualify. Terrible people.

    • The SS Administration is not telling people to appeal by phone so they can turn them down again. They are saying this to relieve the field offices of walk in traffic. Having said that, I advise anyone who is filing an appeal to do it in person. Why? How are you to know what is missing in your medical file unless you see it? How are you to know what the doctor’s had to say? By looking at your file (request it before you go in) you will be best prepared to present your appeal.

      • hi John. The fastest and easiest way to file an appeal of your decision is online. You can upload documents online to support your appeal, which will help decrease the time it takes to receive a decision from Social Security. Please read our publication “The Appeals Process” for complete information.

      • I know what is iin my file, but it didn’t do any good. I have been trying to appeal for the 3rd time now and the appeals council sent my appeal back to the same ALJ. I have many health issues but the worse is my back. I have been seeing a spine speacialist and he said that surgery is my only option, but now the ALJ wants me to see one of their Dr andIcan only assume that he/or she is just an MD. It is unfair because the appeals council sent my case back to the judge recommending that I be approved. It is comingup on 3 years now and I have had to stop taking most of my meds because I can’t afford to by them right now. I take the only one drug for the pain and ven that is a narcadic and I am just lucky to have a wonderful primary care Dr that keeps me from having to live with the back pain I have to every day.

      • They DO NOT allow you to see the medical report. I was told I was not supposed to have seen mine. It was so contradictory. I asked if my doc could call and clear it up and was told no. I was denied because the word can. Even though, after each CAN, it went on to list all the reasons I CAN’T. They do EVERYTHING IN THEIR POWER, and then some, to Deny you

    • Totally agree with you going on 7yrs now denial after denial a win in federal civil court and denied again ruthlessly my life is so screwed they are bad

  3. I’ve already appealed and got denied…I got an MRI and dr notes to support my claims and I can get any new MRIs or other tests done cause I can’t afford it I have no insurance and don’t work cause of my condition and the SS office knows this and still refuses to offer me help…

    • File for a Hearing and get an Attorney who will collect only if you are approved. Get on MEDICAID at the County Assistance Office.

    • Check the http://www.socialsecurity.gov/compassionate allowances. It announed some new conditions and 225 illnesses that can be approved in 7 to 10 days. You have to ask the social security person to look on that list because, they wont look unless you ask. After I finished giving all my medical conditions and information, I asked the lady to look. She said, “Oh, let me check it for you?”. Social Security workers wont look at the list unless you ask them to look on the list. I found a Social Security News Release dated January 15, 2014 for Immediate Release, by LaVenia J. LaVelle, Press Officer. press.office@ssa.gov.

    • Thank you for your question Diana. Social Security strongly supports those individuals who want to return to the work force while supplementing their disability benefit income. We have Work Incentives that allow people to work and still receive their benefits. A person may still be eligible for disability benefits under the Social Security Disability Insurance program if they work. However, their earnings cannot exceed a certain amount. This is called the Substantial Gainful Activity (SGA) limit. In 2016, the SGA limit is $1,130 per month (or $1,820 for blind applicants). In addition to the amount of money you make, Social Security may also look at the number of hours you’re able to work. We hope this information helps.

      • I was told over the phone that my claim was denied. I havent recieved the letter yet. But i provided all my medical documents. Dating from 2003 to 2017 all consistently stating I have PTSD, borderline personality disorder, severe depression amd anxiety. I had an rfc filled out by my therapist. Several supporting papers. Even one that excused me from working because of my mental health condition. If I was truly denied then how are aljs really making a proper decision based off of medical facts? It just seems that the ssa wants everyone denied. I have these issues. I wouldnt apply for disability if I was able to work. The VE even stated I couldnt work. This is insane and unjust.

        • Hi, Jennifer. We are sorry to learn of your condition and to hear that your application for disability benefits did not go the way you had hoped.. For your security, we do not have access to information about your account in this venue. However, you can file an appeal and ask the Appeals Council, to review your case within 60 days of receiving the decision from the ALJ. You cannot file this type of appeal online. For more information on how to appeal a hearing decision, check out our publication, Your Right to an Administrative Law Judge Hearing and Appeal Council Review of your Social Security Case. If you need help requesting a review, contact your local Social Security office, your local hearing office or call us at 1-800-772-1213 (TTY 1-800-325-0778) between 7 a.m. and 7 p.m., Monday through Friday. Thanks.

          • That 1-800-772-1213 is a joke!!! Said I would have to wait 1 hour and 30 mins. so I did the automated thing where they call you back. It was TWO hours and the woman was thee most rudest person I ever spoke with. When I feel better, she will be reported. That was a horrible experience as this whole process has been! They jerk you around so much that it has made me lose more faith in the government. I’ve worked all my life, that’s OUR money, NOT theirs!!!! I hired an attorney and I suggest all of you do seriously! They lead you on. Funniest thing ever is the doctor that did my surgery and was listed on every paper I filled out has NEVER been contacted by them. Watch for that too friends! I wish you all the VERY BEST!!!! They do NOT care about us at all!

          • Hi Linda. We are sorry to hear about your unpleasant experience and we understand your frustration. You can submit feedback by visiting our Contact Social Security page. Once there, select the “Email Us” link. This will take you to the “Email A Question to our Support Team” form where you can complete and submit a compliment, complaint, or suggestion. Sometimes it may be best to visit your local office for assistance. We hope this helps.

  4. This is a real joke.
But if you’re a young black that robs & kills, the govt. will help you.
Govt. all over the world are nothing but licensed thieves.
The USA used to be the best country on earth, still is as a country, but its govt. stinks.
We must thank to the elusive & liar at the W H.

  6. Your strategy is to time people out of their credits. You are liars and thieves with an excellent public relations team. Your workers treat sick people with disgust, impatience and haste. You create a false need for documents to meet your denial quota. You contract work out, you send letters without contact names, you create stress in the lives of people who have paid into the system and have earned enough credits. You purposely deny people creating loss of their homes without a care to the down payment and years of paying down their mortgage only to lose it. Your workers fail to understand the connection between physical disability, fatigue, shortness of breath, inability to move, muscle problems, how the cold affects muscles, the stress the body goes through, the stress the mind goes through. You could care less. You provide no help to people who desperately need it in hopes they’ll turn to alcohol or drugs because that’s what your staff conveys. Your staff are horrible people. The Hispanic animals who have been there the longest are the worse. You pride yourself on employing minorities so when minorities give to their own you fail to realize they take away from others. You support spousal abuse. You are not in support of women or women with child. Your staff seeks every opportunity to financially harm women. There is no ombudsman/judge/higher up to seek remedy. Everything is a wait or more information from you when clearly someone who has high blood pressure resulting from continuous stress you’ve put them through. Hopefully each and every one of you gets the worse form of cancer or your children get the worse form of cancer and they wait for as long as you have tormented others.

    • If they denied u, u deserve to be denied, u racist, full of hate, black hearted evil person. God have mercy on you.

    • So long as you appeal., you cant be “timed out on your credits” and Hispanic animals ? Maybe its YOUR attitude and treatment of people that cause you problems ?

    • I understand your frustration, believe me, I am currently going through the same torment. I’ve been trying to get some help dentistry /healthcare wise for 3 yrs! ..as I deteriate and watch my teeth fall out !! But…you should never, ever wish cancer on anyone ESPECIALLY a child., that is uncomprehensible. I know you could not have meant that,(at least I hope you didn’t)

  7. My 87yr old Dad we’re on line trying to set up an account to a copy of benefits award sheet and W-2 and found information about a Dec.2015 car loan that neither of us are aware of and our application was denied. We need the above documents in order to present to the mortgage company

    • Please call our toll-free number at 1-800-772-1213, for assistance. Representatives are available between 7 a.m. and 7 p.m., Monday through Friday but you will generally have a shorter wait time if you call later in the day, or later in the week. Thanks!

    • Call the Credit bureaus and Dispute that and anything on your reports that is not yours. They have to check it out throughly and clear the incorrect info on your credit reports and send you back their findings.. Creditkarma.com gives you your info online for free. Once the incorrect info is removed, then you can contact social security again. Also, check out this social security Immediate News Release on January 15, 2014 below for special approval with no attorney needed for the program. http://www.socialsecurity.gov/compassionateallowances for a list of 225 disability cinditions. Over 200,000 people have been approved through this fast tract disability program that ssa reps can’t tell you about, but you must ask them for it. I hope this helps.

    • W2 forms come from employers. Your Dad is 87 and working ?? SSA has nothing to do with records of car loans, check with the major credit bureaus.

  8. yes, it is NOT easy to get ssdi benefits!

it took me 5 yrs. of hell to be approved on my 2nd ssdi app since my lawyer who quit me 4 yrs. into this NEVER submitted a BRIEF to appeals counsel since admin law judge office NEVER gave lawyer or me a copy of the tape of my alj meeting!

i have 3 drawers full of medical file records!

NEVER GIVE UP; appeal over & over until after you have had a 1 on 1 with admin law judge meeting!

    bettyg, iowa

    • What do you mean by a one on one meeting with the alj? I have been waiting almost five years and just recently my case was seen by the federal judge. He remandedmy case back to a new alj just a couple of weeks ago me and my federal attorney went before a alj and I am currently waiting for a decision. The hearing was almost2 and half hours long, much longer than the last two hearins with another alj. My first two hearins were with the same alj who denied me twice and was told by the appeals council he was to make a new decision thathe did in fact make 7 procedural error’s. When I went before him he heard the caseand made me wait three months just to deny me again, So my attorney referred my case to a federal attorney and she took my case. She filed a civil law suit against the state I live in and the commissioner deniedne as well, they said they agreed with the alj. If course they did. So my federal attorney filed a civil law suit againsttge stare I live in and 9 months later she net with a federal judge, She called me to tell me that the federal judge agreed that the alj has made many mistakes and recently remanded my case back to a new alj. Like I said as stated above that my hearing was two weeks agoand I am waiting for a new decision. I never heard a one o one like you wrote in your blog. At this hearing there was a vocational expert and e told the judge there was not any jobs I could do. At the very end of my hearing the alj asked me a set if questions which were not asked by the previous alj. One if the questions was did I ever collect any workers comp or any unemployment benefits. I told him no. There was a couple more questions similar to that so I am praying that I get approved this time. This actually was my third hearing which has taken five years. I am 53 years old and I suffered a few strokes, with extensive damage to many parts if my body including damage to the nerves or muscles in my eyes. I had worked 30 years prior to my strokes. I did win my ERISA DISABILITY case a few tears ago which I had purchased short and long-term insurance through Prudential. After two appeals another lawyer I had that specializes in ERISA DISABILITY won my case. The only problem I have with this is that he offsetted my benefits by 80,000. He told the insurance company I WAS RECEIVING STATE disability which was not true. This is why I am so upset because not once has this ever been mentioned to the alj. I am not understanding how could they offset something I never received? Plus how do you offset something I purchased through my employer for thirty years. I understand workers comp because you didn’t pay into that, but not a private disability plan I purchased. Do you know anything about this at all? It has never sat right with me at all. How do you win one and not the other? It seems odd. Any help would be appreciated. Thank you.

  9. I have epilepsy and have for 40+ years. I have applied for SSI for 12 years now and have been denied for 12 years now. I have medical documentation from hospitals, doctors, ER, and EMT but still denied. I have proof that I have seizures but am still denied. I have people who have witnessed my seizures but still denied. Why??? SSA has done nothing to help me. They are all crooks imo, thinking only of themselves. I have no job and no healthcare insurance because no one will hire me due to my condition. Just waiting for the feds to fine me for no insurance, hahahah can’t squeeze blood out of a turnip.

    • I have always been amazed by how Americans will go above and beyond to help every country imaginable with medical and dental care, food, clothes building homes, adopting needy children in 3rd world countries to bring back to the U.S. DOESN’T ANYONE SEE ALL THE HOMELESS,PENNYLESS,HUNGRY AMERICANS. PEOPLE WHO NEED MEDICAL and DENTAL CARE ,NOT TO MENTION the BABIES and CHILDREN IN NEED OF LOVING FAMILIES TO SHARE THEIR LIVES
Open your eyes they are all around us and you don’t have to go any further than your “backyard”

  10. Please look into improving the SSDI and SSI process..for a country as progressive as our great country of America, it is so important to update this element of benefits to those deserving. My daughter has 25 to 30 seizures a month..among with other debilitating chronic conditions…her claim is now with the Appeals Council…she applied initally in June of 2013.
Your consideration and assistance will be applauded by many.

    • This site was not set up to handle specific cases. Some feel that it is Progressivism that is leading to the Country’s destruction. Best of luck with the APR.

        • Please be aware that our official agency responses will always include the Social Security Administration (SSA) seal, and that we have an official social media team dedicated to posting messages and responses to customer inquiries or comments that specifically address SSA issues.

    • Check the http://www.socialsecurity.gov/compassionate allowances. It announed some new conditions and 225 illnesses that can be approved in 7 to 10 days. 11. Why can’t these government agencies work together? I have been deemed 90% disabled thru thru the VA, yet, SS doesn’t deem me to be! On appeal at present, after VA doubled my rating in one from 40 to 90 in one appeal. Why can’t the SS realize that the VA is seeing something that obviously they are not, and approve me. WHY must we all go thru this process and stress?? There are new people graduating from colleges every day and have trouble finding jobs due to people being told they need to continue working….leaving less jobs open for new graduates!! We work to earn the right to retire, only to be told we can’t!!

    • Thank you for your comment Robert, and thank you for your service to our country. If you are receiving benefits from the VA, please keep in mind that the Social Security Act sets out a very strict definition of disability, much different than the requirements for other government programs including veterans benefits. Social Security pays only for total disability. No benefits are payable for partial disability or short-term disability. We use the same five-step process to make a decision on each application. See our Disability Planner: How We Decide If You Are Disabled for more information.

      • You’re replies are robotic. Are you a robot or do you just lack a heart?

People are starving in the streets because SSA denies them the benefits they deserve. Look at all of the lawsuits people have to file taking up taxpayer money.

  12. “If We Denied Your Application, You Can Appeal Online”? What good does that do when the issue is a “Rule” that the Socialist Security System uses to discriminate against “certain” people. If you are a “physically disabled person” (AKA-certain people) and happen to marry an able bodied person, then the SOCIALIST SECURITY system will use special “Rules” to legally discriminate against you and deny you benefits, even if you appeal online.

The SOCIALIST SECURITY system has caused me a lot of economic hardship all because I married an able bodied person. The SOCIALIST SECURITY system thinks someone who is physically disabled (permanently and totally disabled) marries an “able bodied person”, that somehow magically they are cured of their physical disability and two people can survive off the able bodied persons income. WOW, talk about a bunch of bureaucratic idiotic thinking, that somehow this would not cause a financial hardship….. amazing.

The rules that the Social Security Administration uses to legally discriminate against persons who are “Adult Disabled Children” who happen to marry an able bodied person, are discriminatory. This is loosely referred to as the “marriage penalty” but I call it exactly what it is, a legal form of discrimination.
I firmly believe this rule, is an act of bias, prejudice and discrimination against people who (by no fault of their own) are born disabled and happen to marry an able bodied person

Please write your Congressional Representative and tell them to end this modern day form of Legal Discrimination. In this day of fairness and equality, there are still some people suffering from an outdated and oppressive bureaucratic rule.

  13. Whatever happened to the human touch. It is more reassuring to have a live person to talk to-to help solve these situations. It is too sad that we have to rely on the computer for any situation…which makes it frustrating and anger and everyone does not have a computer or always know how to use one.

  14. My sister has been waiting for years for disability. They tell her she can clean houses for a living or work at a desk. Her back is so bad that her doctor told her if she were ever rear-ended in a car accident again, she could become paralyzed. Clean houses? Are they crazy? I understand that the percentage of Americans on disability has risen dramatically. People need to seek help for their pain and try to work if possible. There are too many looking to the government for a handout. But, when it hits home, like with my sister, you see the system for what it really is. They try to wear you down and wait you out until you quit in disgust. Work if you can, but if you can’t, get an attorney.

  15. How can I obtain a copy of my previous employers and dates worked?? Also, is the any cooperation with the V.A.? ??

    • Hi Melvin. To obtain a “Detailed Earnings Information” record, you must complete and mail a request (Form SSA-7050-F4) to the address provided in the form. You can also create a my Social Security account to review your earnings record. For more information, you can call our toll free number at 1-800-772-1213. Representatives are available Monday through Friday between 7:00a.m. and 7:00p.m. We hope this information helps!

  16. The appeal process should be long to where a person’s work credits expire. They shouldn’t have enough work credits to have two simultaneously applications during the appeal to the federal court. It creates double the work and costing tax payers more money.

The SSA tried to eliminate the backlog and ended up approving many people who were not disabled.

People who are denied for SSI by the ALJ are just going to apply again and waste more of the tax payers money. Why speed up the process where the tax payer lose more money?

  17. A single person applying for SSI can only have $2000 in resources. The appeal process takes two years. These people are no getting Section 8, but living at the same address for two years.

They claim that they are paying all the rent, utilities, and food themselves for two years to get the maximum amount of SSI.

These people get away with hiding resources and the tax payers have to support the freeloaders.

  18. Why is it that you basically have to be near death to earn disability? Maybe to some…
But!? A Veteran! Countless veterans have disability that your can’t see. I have met numerous battle buddies and veterans at the Community Base Outpatient Clinic that are suffering from Depression, Mental Mood Disorder and Chronic Stress Disorder…PTSD. The Veterans fought for you so can enjoy the Freedom. I am one of the Veterans that was denied for disability. I had contributed for over 40 years.

  19. Those VA psychologist/psychiatrist will diagnose veterans with a severe mental illness just to keep their job and for job security. If they are seeing a bunch of patients, then they won’t get fired.

There was a veteran who stole $1.5 million in VA benefits and $133,000 from Social Security.

This is reason why it is harder for veterans. The SSA OIG has caught a bunch of veterans. Veterans are a bunch of fakers too.

  20. When someone retires with a $40K+ private retirement pension and gets approved for another $20K+ Social Security disability benefit, then they are probably not disabled at home. They will be living the good life on vacation, entertainment, sport, etc. You are not going to see them need any help with their daily activities. These people with very large private pension are the ones you should investigate. It took the SSA forever to catch onto the New York police and firemen.

  21. This is my experience in the military. When you are exiting the military and you have a behavior problem, they send you to the behavior analysis. They give you the MMPI test. They are quick to diagnose you with a mental disorder. I told them I did not understand the question and there was nothing wrong with me. When there is nothing wrong with you, you might get a general discharge or a bad conduct discharge.

The others who blame their behavior on mental illness get a medical discharge and freeloader off 100% VA disability benefits. Crappy military service gets rewarded with 100% VA disability benefits.

  22. My sttorney told me that SS would pay me from my first application (1999). I started receiving my SSDI benefits in 2012 not back paying from1999. Where do I send documents to? Will the SS payments stop while research is going on? Also, I have information from the Ticket to Work Programs. Hoping to get more WFH opportunities. Thank you!

  23. My attorney told me that SS would pay me from my first application (1999). I started receiving my SSDI benefits in 2012 not back paying from1999. Where do I send documents to? Will the SS payments stop while research is going on? Also, I have information from the Ticket to Work Programs. Hoping to get more WFH opportunities. Thank you!

    • Hi Lindora. Please call our toll-free number at 1-800-772-1213, for assistance in your case. Representatives are available between 7 a.m. and 7 p.m., Monday through Friday, you will generally have a shorter wait time if you call later in the day, or later in the week. Thanks.

  24. If an application was denied and it has been longer than 60 days can we still file an appeal or would we have to start from the beginning?
Also, if we have lost the decision paperwork how would we go about getting another copy of the paperwork?
    Thank you,

    • Hi Dave. Generally, you must make your request for an appeal within 60 days from the date you received your notice of denial. We assume you receive the denial letter five days after the date on the letter. Please call our toll free number at 1-800-772-1213 to request a copy of the letter and to discuss your case before deciding to file a new claim. Representatives are available between 7 a.m. and 7 p.m., Monday through Friday but you will generally have a shorter wait time if you call later in the day, or later in the week.

  25. my name is Cynthia, I have been on Social Security Disability since2000 I am now 63 can I go on Medacare or what ever you go on when you reach retirement age 65 can you go on it at 63? I have part A need to get parts B and D and a suplement can.will my monthly checks stay the same or will it go down? I dont have a clue what to do first. can I enroll over the internet? or go to a office was wondering if I could go at 63? need answers Please

    • Hi Cynthia. Medicare is our country’s health insurance program for people age 65 or older. However, Individuals can become eligible for Medicare benefits after they receive disability benefits for 24 months. We start counting the 24 months from the month they were entitled to receive disability, not the month when you received your first check. In 2016, the standard Part B premium amount is $121.80 (or higher depending on your income). However, most people who get Social Security benefits will continue to pay the same Part B premium amount as they paid in 2015, which is $104.90. Generally, the premium amount is deducted from your monthly benefit payment. For security reasons, we do not have access to personal records in this venue. Please contact the local Social Security office or call our toll free number at 1-800-772-1213, Monday through Friday, between 7 a.m. and 7 p.m. for further assistance and an explanation. Thanks.

  26. I have been denied twice. I filed for an appeal on Nov 1st,2015 to get a hearing.I received a letter shortly after saying I would receive paperwork in several months with my court date. Does anyone know how long it really takes or how I can find out how much longer it will be?

    • Thanks for your question Tom. The length of time it takes to get a hearing can vary from state to state. We attempt to resolve all claims promptly, but there may be delays due to the volume of pending appeals in your area. The good news is that we are trying to conduct many of our hearings through video teleconferencing (VTC) to speed up the process. Visit our “Hearing And Appeals” web page for more information.

  27. I have applied many times for a account. But it says you need a state side address. Well I don’t have a state side address. You tur me down automatics to. So I can’t even chane me address because I do t have a stateside address. Comon. Give me a break. I live in mexico. Explain this for me.

    • Hi Stanley, if you’re referring to opening or creating a “my Social Security account”, you must have a U. S. mailing address to create or to access your online account. The “my Social Security” authentication system requires address verification as one of the essential criteria for creating an account. People with APO/FPO/DPO addresses can create an account overseas, but our system does not support registration and account creation for users with a foreign address yet. if you are now living in Mexico, please contact your local U.S. embassy or consulate for assistance related to Social Security benefits. 28. My daughter’s disability claim has been denied for the second time. I have read the different publications during my filing for benefits and denied, while being misdiagnosed; and don’t qiute understand how the guidelines are being applied. She has a rare hereditary primary immunodeficiency along with other co-existing conditions. We are the only family in our entire our health system with this diagnosis, and we are their learning curve after multiple misdiagnosis. Medicaid has her classified as having catastrophic illness and her medication cost over one million dollars a year. Our health system is teaching and creating a standard of care based on our input and health outcomes. So, the people who are making the disability decisions, are they basing it on knowledge of disease along with medical evidence? In the case of rare disease, what consideration or knowledge is given to make a determination? If she was diagnosed with AIDS/HIV or drug addiction, would she actually be approved?

    • Sounds like we’ve all been shut down because the Judge is NOT a Doctor.

I truly hope things get better for your family and your Daughter. I truly don’t know what else to say, it’s disgusting and soooo not right. 🙁
      Sending Hugs.

  29. Hi, I have been waiting 4 1/2 years for a decision on my disability case and unfortunately when my Dr. told me to file, because she saw my degeneration with every visit. I have had major depression since I was a child, PTSD, I have panic attacks when/if I leave the house. I have such bad chronic pain that I’m in bed most days. I also have Fibromyalgia and probably 90% of the symptoms listed, degenerative disc disease in lower back, which a new MRI shows it’s in my neck as well, some days I can’t move my head, major memory loss, bursitis, pancreatitis, Hypothyroidism & I need my gall bladder out. I could go on, but why bore you?

When I had to look for representation, I had no idea what I was doing, ZIP! I asked a lawyer friend if she knew of any and she didn’t but was going to a convention and would ask there.

What I got out of it is HE!! Binder & Binder. I don’t want to get riled up, I haven’t slept for 2 days and am delirious. But, my advice. Avoid at all costs.

I’ve been in appeals for god knows how long, no one ever has any answers and I can take this, my depression is getting worse and I just don’t want to be like this anymore. Because of all this, my life is in shambles. When I stopped working, there went $50K + down the drain and we lost our house, my car has been impounded (thankfully my in-laws helped). My Husband has drained his 401K just so we could go to a million Dr.’s, Rx’s, food, rent etc. and I feel awful and guilty. I’m being taken for a ride that I can’t get off of, because I signed a contract. I’m sorry, I just needed to vent. Thanks, if you made it this far, I’m at my wits end.

  30. I got a lawyer and appealed my denial back in October 2015. How long does it take to hear about a decision or hearing? Not making enough to survive since feeling so bad and not being able to work with my Lupus flares:(

    • Thanks for your question Christine. The length of time it takes to get a hearing can vary from state to state. We attempt to resolve all claims promptly, but there may be delays due to the volume of pending appeals in your area. The good news is that we are trying to conduct many of our hearings through video teleconferencing (VTC) to speed up the process. Visit our “Hearing And Appeals” web page for more information, and continue working with your attorney and local hearing office on specific questions about your case.

      • parked to go to the comet store found they were closed for alteration to the store so i got my wife on the mobile and asked her were she was and she said m&s on going on foot to meet her i had my fall

  31. I originally applied for retirement benefits in Oct. 2016. I was denied because I didn’t have enough credits. In Jan 2017, I had enough credits to apply. Should I reapply or appeal the first decision?
    Thank you

    • Thank you for your question Mr. Becerra, you should try to file a new application online. If you cannot apply online or you decide not to finish applying online, for whatever reason, you can apply in person at any Social Security office or by calling our toll-free number, 1-800-772-1213 for assistance. Representatives are available between 7 a.m. and 7 p.m., Monday through Friday. Generally, you’ll have a shorter wait time if you call later in the week. Happy retirement!

  32. I have been denied twice now for disability. Neither time has an explanation been given as far as actual rationale. Is this normal procedure? I have Central Pain Syndrome. It is full body and an Intractable Pain. This means there is no known effective treatment. According to medical literature, it is nearly always permanently disabling. The pain is severe and will never end. I’m only 40 years old and spend the majority of my time laying down. I cannot handle even part time work of the most basic kind let alone full time work. My condition is more severe than the majority of conditions on the blue list. It is the same thing that Howard Hughes had later in life. Unfortunately, I’m not a world renowned wealthy man. What steps do I need to take to get this insidious condition listed? Death from this disorder usually is due to suicide or stroke, both greatly limiting average life span. It seems like a good candidate for listing. I want to do whatever I can to keep another person from having to go through this lunacy of a system.

    • Thank you for using our blog to communicate with us! For assistance with Social Security benefits, please contact the nearest U.S. Embassy in your area. 50. Filed for SSDI in Jan 2017- denied. Filed for Reconsideration and provided even more medical records, which specifically stated the worsening of my progressive brain deterioration, the fact that it will continue to progress and the irreversible damage to my brain is the direct cause of my memory and cognitive impairment. BOTH denials stated that my condition is not expected to last 12 months!? My claim is now stuck in a queue to wait for an ALJ hearing, which will take at least 2 years in my state. This has to be a case of procedural error or a case of willfully ignoring my medical records, on the part of the DDS.

  51. I have been denied twice already and told to appeal…but I tried and they told me I have to paper appeal… I have Graves eye disease, Hasiomotos disease, Fibromiagia, IBS, ..Thats just my autoimmune disorders….they include sever chronic anxiety and panic attack, depression and in my case agoraphobia. My body is constantly fighting itself… Environmental triggers as well as too, and just regular daily stress causes flare. I have chronic vertigo due to my eyes , so I haven’t driven a car in over 4 years..but the vertigo…depending on the day makes it hard to just walk…and the fibro in my neck and shoulders sometimes makes it to where I can’t even hold my head up…and yet…with all my paper work…and proof…I was still denied…and asked to do a in person appeal….I have turn agoraphobic due to the fact I need a bathroom IBS near at all times…and the panic attacks…which don’t last 5 or 10 mins….no mine last 6 to 8 hours and causes me to physically hurt myself due to tensing up…but yet..they expect it to be easy…..I will appeal…and hopefully they will see me at my worst.. And let see what they say then… Its so sad that people who don’t need it or are faking can get it..but those who try and do right and legal can’t… But I will be appealing…because this is my way of moving forward and getting the help I need…mentally and physically… This is not me giving up or giving in.

  52. 2000 pages of documentation, ms, afib, degenerative nerve disease, 9 bad discs, regular spasms of pain that cant be controlled, nerves in the hands screaming just after typing for a few minutes due to fine nerve neuropathy, five doctors reports saying she not work and even your own.

Even the five month waiting period was rough we had to sell nearly everything and move 108 miles away from my work to get through it on just my income so she could still be close enough to her doctors to drive to them. Which she has three doctor visits a week.

She gets denied because you think she can work, with what, doing what, no employer is going to hire someone who randomly spasms in pain, cant type very long or lift much.more than a glass in her hand because of the nerve issues. 9 bad discs which basically have workers comp written all over them. Even the state would run out of that interview screaming

Now it looks like another 5 -12 months of appeals. At this point I am going to end up on ssdi as well purely from the stress of already long commute combined with 60hour work weeks. I hope the bi polar in my blood doesn’t catch up to me during this scenario. I’m quite sure the ssa is trying to kill me or the wife.

  53. I need a copy of my denial. My case number, from August 25, 2010, is 0767867. The letter is needed to certify I do not receive any Social Security benefits, in order to receive food stamps and my Colorado Old Age Pension welfare check. The copy can be sent to:
    Rex Cleveland
    661 Bennett Ave. 2C
    Glenwood Springs, CO, 81601
A printable copy sent by email would also suffice.

    • Hi William. Please call our toll free number at 1-800-772-1213 to request a copy of your denial letter. Representatives are available Monday through Friday, between 7 a.m. and 7 p.m. Generally, you’ll have a shorter wait time if you call later during the day or later in the week.
Also, you can create a personal my Social Security account and get a benefit verification letter stating that you do not receive Social Security benefits.
Just a reminder – Please be cautious about posting personal information on social media channels. Thanks!

  54. I had my taxes was taken because I was told i was overpaid from not reporting my job income from 2015 I didn’t go back to work until 2016 My employment records show that to be a fact

  55. Its inconceivable to me how the Social Security Administration can still have a senior citizen who is an American citizen like Ricardo Ramirez SS# *** – ** – *** still be denied his monthly benefits. he has not received his benefits since january 3 rd just because his form arrived late. The man is 83 years old, ill and will be put out on the streets soon because he depends on the benefits they send him monthly to eat and pay rent, he has been desperately calling long distance leaving priority messages only to be ignored. What is Mr. Ramirez to do? I´m sure Social Security will tell him to wait a little longer on his next long distance phone call which he can´t pay for.

    • Thank you for your question, Rosa. If you were recently denied Social Security benefits or Supplemental Security Income (SSI) for medical or non-medical reasons, and you still do not agree with our decision, you have the right to file an appeal. You must make a request within 60 days from the date you received your notice of denial.
Generally, there are four levels of appeal. For more information on the appeals process, please read our publication: “The Appeal Process“. We hope this helps !

  56. I was just denied from an ALJ judge. But what bothers me is my attorney did not represent me at all.I mean she said nothing to help my case. She to me acted like she wanted to be somewhere else. She arrived at the hearing place over 5 min. Late.I never was able to go over CD disk and records contained within.I had no idea of what to expect .I called afterwards and told them my anger and disappointment. They sent a letter to me saying they weren’t going to charge me.Waited 27 months for the hearing in which they took no measures to help me. Also my insurance changed in the beginning of the year and lost months of Doctors visits and evaluations to use as recent medical records, because it’s now taking a month and a half to get referrals from insurance.I was described medication that took 3 weeks to receive. My last doctors visit was Jan 19,2018 and just received a referral less than a month ago to see a specialist .My appointment is July 3rd.This is the only appointment I have been able to make .This is ridiculous.

  57. I was just wondering if the person who is waiting for an appeal answer can get a part-time job or work at all

    • Thank you for your question, Mario. Yes, a person may work while waiting for a medical determination.
You may still be eligible for disability benefits under the Social Security Disability Insurance (SSDI) program if you work. However, your earnings cannot exceed a certain amount. This is called the Substantial Gainful Activity (SGA) limit.
In 2018, the SGA limit is $1,180 per month (or $1,970 for blind applicants). In addition to the amount of money you make, Social Security may also look at the number of hours you’re able to work. For more information visit our “Frequently Asked Questions” web page on disability.
      We hope this information helps.

  58. of course like your web site however you have to test the spelling on quite a few of your posts. A number of them are rife with spelling problems and I find it very bothersome to inform the reality however I’ll surely come back again.

  59. what is the law on timely decisions for cases seeking back pay: 12months, 13months, or 18months. and does the fact you are already receiving benefits help your case. If not can you explain why not?

    • Hello Thomas. We can allow retroactivity payments up to 12 months for disability claims. However, retroactivity cannot be before the claimant’s date of disability onset or the 5-month waiting period. We generally allow up to six months of retroactivity payments, for retirement and survivor’s claims. No retroactive benefits are payable for any month before individuals reach their full retirement age.
Please call our toll free number for further assistance. Representatives are available Monday through Friday, between 7 a.m. and 7 p.m. Thanks!

  60. I to appeal or at least relate my information, but it asks for my recent letter, and I only got one letter and that was in April.I was told by a gentlemen in Hibbing, MN three days ago that they would increase the amount they are deducting to 127.00 and when I called today the lady said I would get nothing in august and asked if I read the July letter. I didn’t get a July letter, only the one in April that I responded to immediately and the decision was to deduct 75 from each check. She said I get nothing in August because I did not respond to the July letter that I didn’t even get. How can this be rectified. Sort of flabbergasted when I went to the bank on the 8th and nothing. I will be happy to have whatever deducted each month, as long as I get some check.

  62. I filed an appeal to my denial to renew mt extra help for my medicare. I was made and appointment for my state appeals hearing but was, at the last minute, unable to keep the appointment. How do I reschedule a hearing?

  63. My name is Jiaqi Liu and I am here for help. I am an international student that just graduate. I submit my application of social security number within the same application of employment authority. I received my EAD card in August, but not my SSN. I visited SSA several times and figure out the reason.

There is another female called Jiaqi Liu who has the same birthdate as mine already has a SSN. So every time when I submit my application, it was denied due to mistaking me as her. I have been waiting for two months and still been denied. But I really need to work!

Please indicate what could I do.

    • We apologize for any inconveniences. Unfortunately, but for security reasons, we do not have access to personal records in this blog.

  64. My monthly amount is 339.50 and you deduct 122.50 for Medicare and you say I will receive 197.00. I don’t think that is right.

  66. I have been waiting for a hearing date a disability claim denial since May 2018. The website does not give any updates, for example a time line on when a date will be set or anything. There is no email address to ask for a time estimate on when a hearing will date will be set. The website could afford to be more helpful, since that is where SSA website, phone #’s, etc. directs to sign on to get info on your claim. 7 months an counting, same thing on. No updates, no way to ask for more info. Horrible service.

    • Hi, Alana. Many people handle their own appeals. A representative familiar with Social Security’s programs can provide a valuable service to you. However, the decision whether or not to seek the services of a representative (attorney or other qualified person) is up to you. More information about representatives can be found in our publication, “Your Right to Representation.” If you need help requesting a review, contact your local Social Security office or call us at 1-800-772-1213 (TTY 1-800-325-0778). Representatives are available Monday through Friday between 7:00 a.m. and 7:00 p.m. Generally, you’ll have a shorter wait time if you call later in the day. We hope this helps!

  68. I am writing for my son who has had massive problems since moving to Nevada from Indiana. He went into the SS office JUST to change his address. He was then notified they have to review his case, but was on disability for quite a few years as he was born without arms and legs. He filed an appeal since it’s obvious he’s disabled and the Administrative Judge didn’t show up and his benefits were terminated. The letter stated he is not disabled under your criteria of disability. If you give people disability based on depression (like my neighbor) then I would think a person born without limbs pretty much categorizes a definite disability. What can be done as he is at a total loss right now?

  69. I have been denied MY SSDI . I was told to expect a denial. I am still floored. I meet “The Book” definition for PTSD and have multiple physical deteriorating conditions. Somehow SS has decided I am magically going to get better? I have battled my mental illness since I was 6 years old. Yes 6 years old, from horrific abuse allowed by my mother by her husband. So horrible I will not describe the long term abuse here, I also cannot sit or stand for more than 5 minutes or my feet go numb & the pain in my back starts screaming. My neck is a crumbling mess. I do not have full use of my hands because of nerve compression. I cannot swallow food or water without choking. I have a well documented history of all of my conditions. None of which are going to improve or go away. I’m in pain management because surgery will not fix my neck or back. I even have rare medical evidence of brain damage from long term PTSD, I am on medications which cause side effects that mess with my memory. I have cervical migraines which I have to just ride out, pain meds don’t help. I’m already on a strong pain med that is closely monitored and cannot be combined with anything other than something I would have to get at an ER. I won’t go to the ER. My medical bills would be even worse, There is not a company out there that would give allowances I would need even for part-time work. I cannot drive more than a few minutes from my house or my feet go numb so that sets off an anxiety attack. I don’t drive because I feel I am a danger to myself and others. I spend my days in an adjustable bed talking to myself for HOURS. It is compulsive, I cannot help the obsessive thoughts or flashbacks. I am over 50 and my SS work history goes back to my teens. I have paid into a system that is supposed to be there when I need and now they want to drag me through the coals to get my benefits. It’s cruel. I have mentally and physically deteriorated faster because of the stress caused by this process. The exam by their phsyc doc brought up memories I packed away long ago so now I have flashbacks every day & night.
I read a study that shows the death rate for those waiting for SSDI is higher than the national average. Big surprise right? Where is the compassion in that?
I won’t give up. That is what “they” want us to do. I can’t. I do not have any other option. No one will hire & keep someone like me.
It has taken me almost 2 hours to type this, so no typist jobs for me. This is a horrid, cruel process.

  70. Explain to me how you deny a veteran who got t boned by a ford excursion going 65 into my motorcycle destroying my pelvis and left leg that doesnt work anymore who’s recovery is going to be over a year and that’s maybe if I get my leg function and feeling back. I have permanent rods in throughout the center of my bones in my left leg including on my pelvis yet you deny me because I can use my hands, back, and right leg. If you’re so confident that I can get a job then find one for me. Let me know a business or corporation willing to hire a legless veteran with ptsd? Oh you cant but you’ll deny me because I can work? Said who? My doctor doesnt even know for sure if I can walk again and he said that in the notes. Please explain to me how this is right? I have no money or income coming my way. The country I serve just chews me up and spits me away after sacrificing my body and mind to protect this beautiful country. Then people wonder why human beings turn into savages and do the unthinkable in the world. Hey government stop worrying about impeaching a president and start fixing actually united states citizen problems in the world. Sincerely a devoted united states citizen. Semper fi.

  71. I have been denied several times for disability, I am about
to be homeless again for the 3rd time. I am very worn out, I am staying in a 1967 trailer with no refrigerator and no stove. Jerry Norton is who I reside with he recently had a 5 day hospital stay, with a huge blood clot in his lung, nearly died he doesn’t have long to live. I am asking
SSDI TO CONSIDER ME. Thank you
